These Terms of Service (“Terms”) govern your use of tranquilpots.com and any purchase you make from it. The site is operated by Tranquil Pots LLC, Florence, South Carolina, USA (“Tranquil Pots,” “we,” “us”). By browsing the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By ordering you confirm that the information you give us is accurate and that you are authorized to use the payment method you provide.
Products, descriptions, and availability
We work to describe our pots, trays, trees, tools, and supplies accurately, including dimensions and materials. Handmade and natural products vary — color, glaze, and finish may differ from the photographs, and stated dimensions are nominal and may vary slightly. Living plants vary in form and will not match a photograph exactly.
Availability is not guaranteed until your order is accepted. If an item sells out or cannot be supplied after you order, we will contact you and refund that item in full.
Pricing and errors
Prices are in U.S. dollars and may change at any time before you place an order. Shipping is calculated and shown at checkout before you pay, and applicable sales tax is added at checkout. Every price is re-validated on our servers when your order is created.
If a product is listed at an incorrect price because of a typographical or system error, we reserve the right to cancel or refuse that order even after a confirmation has been sent, and to refund you in full. We will contact you before doing so.
Orders and payment
Submitting an order is an offer to buy. A confirmation email acknowledges receipt of your order; the contract is formed when we accept and fulfill it. We may refuse or cancel any order — for example where we suspect fraud, where an address cannot be verified, or where quantities appear to be for resale without an agreement.
Payments are processed by Stripe. We do not receive or store your full card details. By paying you also agree to Stripe’s applicable terms.
Pre-orders and reserve lists
Joining a reserve list places no obligation on you and requires no payment. Where a pre-order is paid in advance, we will state the expected ship-by window at the time of purchase. If we cannot ship a paid pre-order within a reasonable time of that window, you may cancel it for a full refund.
Shipping, returns, and refunds
Shipping timeframes, damaged or defective items, returns, and refunds are governed by our Shipping & Returns policy, which forms part of these Terms. Risk of loss passes to you on delivery to the carrier; damage in transit is handled under that policy.
Acceptable use
You agree not to:
- Use the site for any unlawful purpose or in violation of these Terms.
- Scrape, crawl, or harvest content, pricing, or images by automated means without our written permission.
- Attempt to gain unauthorized access to the site, its accounts, or its underlying infrastructure, or to interfere with its operation.
- Submit false, fraudulent, or abusive orders or messages.
Intellectual property
The site’s text, photographs, graphics, layout, and the Tranquil Pots name and logo are owned by Tranquil Pots LLC or its licensors and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from them without our written permission.
Plant and product care disclaimer
Growing guidance on this site is offered in good faith for general information. Results depend on climate, soil, water, light, and care, all of which are outside our control. We do not warrant any particular horticultural outcome.
Disclaimer of warranties
Except as expressly stated in these Terms or our Shipping & Returns policy, and except for warranties that cannot be excluded under applicable law, the site and the products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Tranquil Pots LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost plants, or lost data, arising out of your use of the site or the products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability for fraud, personal injury, or any liability that cannot be limited under applicable law. Some jurisdictions do not allow these limits, so they may not apply to you.
Indemnity
You agree to indemnify and hold harmless Tranquil Pots LLC and its officers, members, and agents from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the site.
Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
Third-party links
The site links to third-party sites, including affiliated stores and our service providers. We are not responsible for the content, products, or practices of those sites.
Changes to these Terms
We may revise these Terms at any time by posting an updated version here and changing the “last updated” date. The Terms in effect when you place an order govern that order. Continued use of the site after a change constitutes acceptance of the revised Terms.
Governing law and venue
These Terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-law rules. You and Tranquil Pots LLC agree that any dispute arising out of or relating to these Terms or your use of the site will be brought exclusively in the state or federal courts located in Florence County, South Carolina, and you consent to the jurisdiction of those courts.
Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions stay in force. These Terms, together with our Privacy Policy and Shipping & Returns policy, are the entire agreement between you and Tranquil Pots LLC regarding the site.
